DMCA Copyright Policy

1. Policy Statement

Cliprise respects the intellectual property rights of others and expects users to do the same. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act ("DMCA") and other applicable intellectual property laws.

2. Copyright Infringement Notification

If you believe that content on Cliprise infringes your copyright, please provide our Copyright Agent with the following information:

2.1 Required Information

  • A physical or electronic signature of the copyright owner or authorized representative
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the infringing material and information reasonably sufficient to locate it
  • Your contact information (address, telephone number, email address)
  • A statement that you have a good faith belief that use of the material is not authorized
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner

2.2 How to File a Notice

Send your DMCA notice to our designated Copyright Agent:

3. Counter-Notification

If you believe your content was removed by mistake or misidentification, you may file a counter-notification containing:

3.1 Required Information

  • Your physical or electronic signature
  • Identification of the material that was removed and its location before removal
  • A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
  • Your name, address, and telephone number
  • A statement that you consent to jurisdiction of the Federal District Court for your judicial district (or the district where Cliprise is located if outside the US)
  • A statement that you will accept service of process from the person who provided the original DMCA notice

3.2 Counter-Notification Process

Send your counter-notification to our Copyright Agent at the address above. If we receive a valid counter-notification, we will forward it to the original complainant. If we don't receive notice of a lawsuit within 10-14 business days, we may restore the removed content.

4. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, Cliprise has adopted a policy of terminating, in appropriate circumstances, accounts of users who are deemed to be repeat infringers. We may also limit access to the service or terminate accounts of users who infringe intellectual property rights, whether or not there is repeat infringement.

5. AI-Generated Content and Copyright

5.1 User Responsibility

Users are responsible for ensuring their prompts and source images do not infringe copyrights. Do not:

  • Reference specific copyrighted characters, brands, or artworks in prompts
  • Upload images you don't have rights to use
  • Attempt to recreate copyrighted works
  • Use AI-generated content that mimics specific copyrighted styles without authorization

5.2 Cliprise Responsibilities

While we provide tools for content generation, users retain responsibility for:

  • Ensuring prompts and inputs don't infringe copyrights
  • Using generated content in compliance with applicable laws
  • Obtaining necessary rights for commercial use where required

6. Limitation of Liability

Cliprise is not liable for copyright infringement by users. By using our service, you agree to indemnify and hold harmless Cliprise from any claims arising from your use of the service or content you generate.

7. Modifications to Policy

We reserve the right to modify this policy at any time. Changes will be effective immediately upon posting to this page.

8. Good Faith Requirement

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing or was removed by mistake may be subject to liability. We may seek damages from any party that submits a notification or counter-notification in bad faith.
